    商务部公布对原产于欧盟的进口相关乳制品反补贴调查的初步裁定

    　　中新网12月22日电 据商务部网站22日消息，商务部公布对原产于欧盟的进口相关乳制品反补贴调查的初步裁定。 　　根据《中华人民共和国反补贴条例》(以下简称《反补贴条例》)的规定，2024年8月21日，商务部(以下称调查机关)发布2024年第34号公告，决定对原产于欧盟的进口相关乳制品(以下称被调查产品)进行反补贴立案调查。 　　调查机关对被调查产品是否存在补贴和补贴金额、被调查产品是否对国内产业造成损害及损害程度以及补贴与损害之间的因果关系进行了调查。根据调查结果和《反补贴条例》第二十五条的规定，调查机关作出初步裁定。现就有关事项公告如下： 　　一、初步裁定 　　调查机关初步认定，原产于欧盟的进口相关乳制品存在补贴，中国国内相关乳制品产业受到实质损害，而且补贴与实质损害之间存在因果关系。 　　二、临时反补贴措施 　　根据《反补贴条例》第二十九条和第三十条的规定，商务部向国务院关税税则委员会提出对原产于欧盟的进口相关乳制品采取临时反补贴措施的建议。国务院关税税则委员会根据商务部的建议作出决定，自2025年12月23日起，采取临时反补贴税保证金的形式对原产于欧盟的进口相关乳制品实施临时反补贴措施。 　　进口经营者在进口被调查产品时，应依据本初裁决定所确定的各公司的从价补贴率向中华人民共和国海关提供相应的临时反补贴税保证金。 　　被调查产品的具体描述如下： 　　调查范围：原产于欧盟的进口相关乳制品。 　　被调查产品名称：相关乳制品。 　　英文名称：Certain dairy products。 　　产品描述：相关乳制品具体包括鲜乳酪(包括乳清乳酪)及凝乳，经加工的乳酪(无论是否磨碎或粉化)，蓝纹乳酪和娄地青霉生产的带纹理的其他乳酪，其他未列名的乳酪，未浓缩及未加糖或其他甜物质的乳及稀奶油(按重量计脂肪含量超过10%)。 　　主要用途：主要作为食品直接或加工后供人消费。 　　该产品归在《中华人民共和国进出口税则》：04015000、04061000、04062000、04063000、04064000、04069000。 　　欧盟各公司从价补贴率在本公告附件2中列明。 　　三、征收临时反补贴税保证金的方法 　　自2025年12月23日起，进口经营者在进口原产于欧盟的相关乳制品时，应依据本初裁决定所确定的各公司的从价补贴率向中华人民共和国海关提供相应的临时反补贴税保证金。临时反补贴税保证金以海关确定进口货物的计税价格从价计征，计算公式为：临时反补贴税保证金金额=海关确定进口货物的计税价格×临时反补贴税保证金比率。进口环节增值税保证金以海关确定进口货物的计税价格加上关税和临时反补贴税保证金作为计税价格从价计征。 　　四、评论 　　各利害关系方在本公告发布之日起10天内，可向调查机关提交书面评论意见。 　　附件： 　　1.中华人民共和国商务部关于原产于欧盟的进口相关乳制品反补贴调查的初步裁定.pdf 　　2. 欧盟各公司从价补贴率列表.pdf 【编辑:胡寒笑】|dfg|
