    警惕公益领养背后的黑生意经

    　　“扫码走流程领猫时，根本没注意还要分期付款！”提起此前“免费领养”一只小猫的经历，就读于安徽合肥某高校的小明气愤不已。原本想“免费领养”却意外背上为期24个月的分期债务，每月需支付398元用于购买猫咪用品。时隔半年多，小明算了一笔账，当她最终结清债务时，所付总费用将超过9500元，远超购买猫咪的实际价值。(3月24日《法治日报》) 　　当下，越来越多的城市青年和空巢老人选择与宠物为伴，宠物作为情感寄托和生活伴侣的角色越发凸显，围绕宠物的生产、消费和服务的“它经济”日益庞大。《2025年中国宠物行业白皮书(消费报告)》显示，2024年，城镇(犬猫)消费市场规模增长7.5%，达到3002亿元。随着“宠物经济”不断升温，线下门店为了在激烈的市场竞争中立足，不断推出新的商业模式，“免费领养”就是其中一种。不过，天下没有免费的午餐，“免费领养”背后暗藏着长期复购、分期付款、高价宠物用品、宠物离世仍要继续还款等诸多陷阱。 　　商家打着“公益领养”的幌子，通过透明展柜中活泼可爱的宠物吸引客流。当消费者产生领养意向时，店员便推出“宠物粮保障计划”“无忧养宠计划”等分期方案，将宠物用品费用分解为24期或36期付款，钱款用于在商家的小程序“商城”购买饲养用品，这种每月定时付款的模式也被称为“宠物贷”。部分商家甚至将付款与征信挂钩，威胁消费者若中途停止付款将影响信用记录。 　　黑猫投诉平台显示，仅解除“猫贷”的诉求就超过千条，暴露出这种模式的普遍性与危害性。这种营销模式本质上是将宠物交易拆解为“宠物赠送+用品销售”的复合合同。虽然名义上是领养，但消费者需持续支付用品费用，实质构成买卖关系。商家通过这种设计规避动物防疫法关于宠物交易的监管要求，同时将消费纠纷转化为合同履约争议。消费者基于对“公益领养”的信任，往往在未充分理解合同条款的情况下签署协议。商家则通过格式条款免除自身责任，例如约定宠物死亡后仍需付款，或限定只能在其小程序购买用品等。这种不对等的合同关系，使消费者陷入“领养即负债”的困境。 　　面对这种新型消费陷阱，需要建立“预防—监管—救济”的全链条治理机制。监管部门应明确“宠物领养”的法律属性，将捆绑销售行为纳入《反不正当竞争法》《消费者权益保护法》等规制范围。建议推行“领养协议备案制”，要求商家明示宠物来源、健康状况及消费条款，保障消费者的知情权。 　　消费者自身也需增强风险防范意识，理性看待“免费”宣传。在领养前应核实商家资质，仔细审查合同条款，特别注意分期付款、违约责任等内容，并留存沟通记录，一旦发现违约行为及时向消协或市场监管部门投诉。对于已经陷入纠纷的消费者，可依据《民法典》第151条关于显失公平的规定主张撤销合同。 　　“免费领养”模式本应是公益与善意的结合，却因部分商家的逐利行为异化为消费陷阱。倡导文明养宠的公益理念成了套路多多的营销手段，不仅损害消费者权益，更透支社会信任。唯有构建起法律监管、行业自律、消费者理性的一体化治理体系，才能让爱心不再被算计，让公益回归本质。当每一只宠物都能找到真正爱它的主人，当每一份善意都不被辜负，宠物经济才能实现健康可持续发展。(胡欣红) 　　来源：北京青年报 【编辑:叶攀】|dfg|
